CONTEST OVERVIEW:


Hidden in the background on the 5 Pepper Porter labels are a series of symbols and icons. These symbols can be more easily seen via the “5PPpuzzlegraphic” cheat sheet displayed on our website at www.ablebakerbrewing.com and promoted on our social media pages. You can view the icon cheat sheet at any time via these outlets so that no purchase is necessary to enter the Contest. The Contest is simple, be the first person to decode the message on the label and submit a properly constructed entry (see Official Rules) and win the Grand Prize. The puzzle hiding within the label is a cleverly disguised cipher, each icon has a specific individual value and/or purpose. Decode the cipher and find the hidden message. We’re going to have some fun with this promotion, so the “solution” will be placed in a black envelope & dangled from the ceiling above our chalkboard taplist…..it’ll hang there until a winner is declared. If no one has correctly solved the puzzle by July 4th, Able Baker Brewing will select a winner from all the properly received entries (see Official Rules), selecting the submission that came closest to solving the puzzle. For the purpose of this contest, “closest” will be defined as “the largest number (most) of correct and properly placed letters”, this to be determined at the sole discretion of Able Baker Brewing. The Grand Prize will be weekly $20 Able Baker Brewing Gift Certificates that you can redeem for any Able Baker Brewing products available at our taproom (hats, t-shirts, glassware, 4-packs, non-alcoholic Root Beer’d, etc.) See Official Rules below for Grand Prize clarification and requirements. 



  1. Eligibility 

The 5 Pepper Porter Puzzle Contest (the “Contest”) is open to all persons who are legal residents of the (50) Fifty United States and District of Columbia, who are at least 21 years of age at time of entry. The Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law 

  1. Sponsorship  

The Contest sponsor is Able Baker Brewing Company (the “Sponsor”), located at 1510 S. Main St. Las Vegas, NV 89104.  Sponsor and its  respective affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees, and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Contest, including without limitation, the immediate family members of such individuals, are not eligible to participate.  Sponsor will conduct the Contest substantially as described in these Official Rules.

  1. Agreement to Official Rules  

Participation in the Contest constitutes the entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning the Grand Prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein. These Official Rules may be viewed at any time via the Sponsors website at www.ablebakerbrewing.com or a printed copy may be obtained on-site by visiting the sponsor’s taproom at 1510 S. Main St. Las Vegas, NV 89104 and requesting a copy. Alternately, you may request a mailed copy of the Official Rules by sending a self-addressed stamped envelope/letter to the Sponsor at:

Official Rules will be mailed within five (5) business days at the limit of one per person.


  1. Entry Period 


This Contest begins on Wednesday, May 12th at 12:00 PM PST and will conclude no later than Saturday, July 3rd at 11:59 PM PST. Entries that are submitted before or after the Contest period will be disqualified. Submissions will be accepted for the duration of the Contest via the following methods:

Mail-In submissions must contain the entrants proposed solving of the cipher along with their full name, mailing address, and phone number.

On-Site – this method of entry will be available for the duration of the contest. Submissions can be deposited into the mailbox just inside the front-door at the Sponsor’s taproom located at 1510 S. Main St. Las Vegas, NV 89104. On-site submissions will be accepted during normal business hours: 12 PM PST to 10 PM PST Sunday through Thursday or 12 PM PST to 11 PM PST Friday and Saturday. On site submissions must be in an envelope addressed to the Sponsor at:

On-site submissions must contain the entrants proposed solving of the cipher along with their full name, mailing address, phone number and the date of submission. Backdated submissions will be disqualified. 


Online – this method of entry will be available for the duration of the contest. During the entry period, visit the Contest registration/entry page located on Sponsor’s website at www.ablebakerbrewing.com and follow the instructions to electronically complete and submit the Contest entry form.  Alternately, you may click through via the “links” tab at the top of the Sponsor’s Instagram page at www.instagram.com/ablebakerbrewing You will be asked to provide basic contact information, including your name, street address, phone number, and email address.  (NOTE: You must complete all required fields of the entry form, with information that is valid, to be eligible).


Any potentially “winning” entry submissions must contain the complete decoded message with no misspellings or errors that deviate from the predetermined hidden message, as determined by the Sponsor. All entries become the property of the Sponsor and none will be acknowledged or returned.


  1. Limitations on Entries


LIMIT ONE ENTRY PER PERSON.  No third-party entry or entry through any contest service is permitted.  Any person who attempts or otherwise encourages the entry of multiple or false contact information under multiple identities or uses any device or artifice to enter or encourage multiple or false entries, as determined by Sponsor, will be disqualified.  Use of robotic entry devices is strictly prohibited.  


  1. Winning Selection.


The winning selection shall be determined to be the 1st entry received and identified by the Sponsor that contains the complete and correct solving of the hidden message found on the 5 Pepper Porter label and/or the “5PPpuzzlegraphic” contest graphic. Once a properly submitted entry has been determined by the Sponsor to be the Grand Prize winner, the contest will officially end, no further winners will be allowed. 


  1. Prize Drawing.


If no winning submissions, as determined at the sole discretion of the Sponsor, have been identified by July 3rd, 2021 at 11:59 PM PST then, on July 4th, 2021 at 12:00 PM PST, the Sponsor will select a potential winner from among all eligible entries received. Selection will be based on those entries that came the “closest” to solving the puzzle. For the purposes of this contest, “closest” will be defined as “the largest number (most) of correct and properly placed letters”, this to be determined at the sole discretion of the Sponsor. The Sponsor will attempt to identify the potential winner via phone or email on or about July 5th, 2021. If the potential winner cannot be contacted within five (5) days after the first contact attempt is made, the Sponsor may select an alternate potential winner in his/her/they place by selecting the entry that was “closest” to solving the puzzle among the remaining eligible entries. Only two (2) alternate drawings will be held, after which the Grand Prize will remain un-awarded. 


  1. Winner Notification.


The potential Grand Prize winner will be notified by the Sponsor via email, mail, or phone. Any potential Grand Prize winner will be required to complete, sign, and submit a Declaration of Compliance at the time of accepting the Grand Prize or within 5 days or the initial attempt of receipt. A Declaration of Compliance must be completed and returned to the Sponsor in order to claim his/her/they Grand Prize. Potential winners must continue to comply with all the terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, the Sponsor will award the applicable prize to an alternate winner by selecting the entry that was “closest” to solving the puzzle from among the remaining eligible entries. Only two (2) alternate drawings will be held, after which the Grand Prize will remain un-awarded. 


  1.   GRAND PRIZE


One (1) Grand Prize will be awarded to One (1) Official Winner. The Grand Prize will consist of: One (1) $20 Able Baker Brewing Gift Certificate awarded each Monday for the remainder of the calendar year 2021. The Grand Prize will begin to be awarded the first Monday AFTER the winning submission is verified by the Sponsor and the winner is contacted and signs the Declaration of Compliance. The number of Gift Certificates to be awarded is not to exceed twenty-nine (29) and the total value of the prize(s) is not to equal or exceed six hundred dollars ($600). Gift certificates hold no cash value and can only be redeemed in exchange for Able Baker Brewing products available at the Sponsor’s brewery, located at 1510 S. Main St. Las Vegas, NV 89104. 

Weekly Gift Certificate values expire each Sunday of the week they are offered/accepted/redeemed at 10:00 PM PST, no rollovers or credit, and no change or monetary considerations will be given on exchanges of gift certificates for the Sponsor’s goods.


  1.   Proxy Designation


The Grand Prize winner will be allowed to have the prize(s) accepted via a proxy, if they so choose, as long as the selected proxy: (a) resides in or near Las Vegas, NV (b) signs a Declaration of Compliance (c) is at least 21 years of age at the time of designation. Proxy designation will be limited to one (1) person and the selected proxy will become the sole acceptor of the weekly gift certificates (the Grand Prize) for the remaining duration of their issuance. The proxy will be bound, and agrees to be bound, by the same obligations, requirements, standards, and rules laid out here in these Official Rules and agrees to be bound by all applicable federal, state, local, and municipal laws. Acceptance of the proxy designation will act as participation in the Contest under clause (3), above. The Grand Prize will remain the same and its issuance will follow these Official Rules regardless of the presence or absence of proxy designation. Proxy approval will be at the sole discretion of the Sponsor.


  1.   General Conditions


In the event that the operation, security, or administration of the Contest is impaired in any way, for any reason, including, but not limited to fraud, virus, computer bug, unauthorized human intervention, or other technical problems, or in the event the Contest is unable to run as planned for any other reason, as determined by the Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to these Official Rules or (b) terminate the Contest and, in the event of termination, award the Grand Prize via a random drawing from among the eligible entries received up to the time of impairment or suspension. The Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules. Any attempt by any person to damage the website, hack social media pages, or undermine the legitimate operation of the Contest may be in violation of criminal and civil law, and, should any such attempt be made, the Sponsor reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent of the law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. 


  1.   Release and Limitation of Liability


By participating in the Contest, entrants agree to release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, social media outlets (Instagram, Facebook, Twitter), other companies associated with the Contest, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the Released Parties) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the Grand Prize, including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider, network, server, wireless service provider, or other connections, availability or accessibility or miscommunication or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or difficulties (b) unauthorized human intervention in the Contest (c) mechanical, network, electronic, computer, human, printing, or typographical errors (d) lost, late, incomplete, garbled, illegible, undelivered, stolen, damaged, delayed, postage-due or misdirected mail, entries, application downloads (e) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the cancellation or postponement of the event and, if applicable, the incorrect downloading of the application or processing of the entries (f) injury, death, losses or damages on any kind, to persons property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Contest or acceptance, receipt or misuse of the Grand Prize. Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall the entrant be entitled to receive attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. 


  1.   Disputes


Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Nevada. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Nevada, without giving effect to any choice of law or conflict of law which would cause the application of the laws of any jurisdiction other than Nevada.


  1.   Privacy


Information collected from entrants is subject to the sponsor’s privacy policy. All entries become the property of the Sponsor and none will be acknowledged or returned.


  1.   Publicity Rights

The Grand Prize winner, in acceptance of the Grand Prize, and via the act of submitting an entry and participating in the Contest, activates the right of the Sponsor to include his/her/they name in conjunction with the Sponsor’s promotion or execution of any and all elements surrounding the Contest, including, but not limited to, the allowance to use his/her/they name in any Grand Prize Winner Listing request (section 18). 


  1.   Social Media Disclaimers


The Sponsor acknowledges that the Contest is in no way sponsored, endorsed, administered by, or associated with, Instagram, Facebook, or Twitter or any other social media outlet the Sponsor may choose to incorporate, use, or access during the duration of the Contest.
